The portal https://www.elevncommunity.com/ (the “Website”) and its corresponding mobile application (“App”) are managed and operated by Elevn. These terms and conditions (“Terms of Use”) constitute an electronic agreement (“Agreement”) between Ekaiva Technologies Private Limited (“Elevn,” “we,” “us,” or “our”) and any natural or legal person accessing or using Elevn in any manner (“you”, “your “or “User”). By accessing or using our Website, App, or services (“Services”), you agree to be bound by these Terms of Use, as well as any other terms and conditions or guidelines applicable to specific Services (“Service Terms”). If these Terms of Use are inconsistent with such Service Terms, the Service Terms will control to the extent of such inconsistency with respect to the applicable Service.

We may modify the Terms of Use at our discretion. We will notify you of any changes that we feel are substantial on the email address you give us or by a message on the App. You should still periodically check our Website for any changes to the Terms of Use. You are bound by the terms that are applicable at the time you use our Services. Continuing to use our Services after the coming into effect of any changes indicates your consent to any changes.

These Terms of Use are generated as an electronic record within the meaning of the applicable law. This electronic record is generated by a computer system and does not require any physical or digital signatures. We recommend that you read these Terms of Use carefully before accessing or using Elevn or availing of any Services. By using Elevn or availing any Service, you signify your agreement to be bound by these Terms of Use.

If you have any questions or require additional information, please do not hesitate to contact us.

For these Terms of Use, the below-mentioned definitions shall apply:

  1. Date: a Date refers to a pre-arranged in-person meeting between two Users who have connected through our Service, with the intent of becoming better acquainted. A Date may vary in nature, ranging from an informal gathering, such as a walk or coffee, to a more structured engagement, such as a dinner or attendance at an event;
  2. Date Location: the designated physical venue where a Date between matched Users occurs, including but not limited to restaurants, bars, cafés, or other public establishments. The Date Location is determined by Elevn, taking into account the preferences and availability of both Users, and is communicated to them through the App;
  3. Parties: User and Elevn will collectively be referred to as Parties.
  4. Third Party/Parties: Any individual, entity, or organization that is not a party to this Agreement.
  5. Account: the personal information supplied and created by the User, utilized for their profile, App preferences, selecting potential matches, and coordinating Dates.

ELEVN’S CHILD SAFETY STANDARDS POLICY

At Elevn, we are committed to creating a safe and respectful environment for all our users, including children. As part of this commitment, we have established thefollowing policy to protect children against sexual abuse and exploitation whileensuring their safety, privacy, and well-being on our platform (the “App”): ELEVN

  • Age Restrictions and Verification.

    To maintain a secure environment, we enforce strict age restrictions. Users must be at least 18 years old to create an account on Elevn. Anyone under the age of 18 is strictly prohibited from using the App. During registration, we use reliable age verification methods to ensure compliance. No exceptions are made for underage users, as Elevn is designed exclusively for adults.

  • Zero Tolerance for Child Sexual Abuse and Exploitation.

    We maintain a zero-tolerance policy for any form of child sexual abuse and exploitation (“CSAE”) on our platform. Any account found to be engaging in such activities will be banned or suspended from using the App, and may be reported to the appropriate authorities for further action. Elevn strictly prohibits:

    (i) The sharing, solicitation, or promotion of any child sexual abuse materia (“CSAM”);

    (ii) The use of Elevn for grooming, exploitation, or any other behavior that endangers children;

    (iii) Any content or communication that violates any of the child safety and protection laws.

  • Content Moderation.

    Content moderation is a key part of our safety efforts. We use automated filters to detect and remove inappropriate or harmful content. Additionally, our dedicated human moderation team reviews flagged content and user reports to maintain a safe environment, with harmful material being removed promptly.

  • Reporting Mechanism.

    We provide users with the ability to report any inappropriate content or content involving CSAM directly through the App. These reports are treated with the utmost seriousness and priority by us and are swiftly reviewed by our dedicated safety team. Our team will investigate all reports thoroughly and take swift action including notifying the law enforcement agencies and addressing them in accordance with the applicable laws.

  • Compliance with Child Safety Laws.

    For us, user privacy and data protection are of paramount importance. We comply with all applicable child safety and protection laws, including the identification and reporting of CSAE and CSAM, as well as with the applicable data protection and data privacy laws to safeguard children.

  • User Awareness.

    Education and awareness play a crucial role in our approach towards child safety. We make efforts to educate the users on identifying and reporting CSAE, and guide them on how to report any concerns they may have. By promoting awareness, we aim to empower users to make informed decisions and use the platform responsibly.



  • User Responsibility.

    All users of Elevn are required to adhere to this policy by:

    (i) Reporting any suspected CSAE related content or behavior immediately;

    (ii) Refraining from sharing illegal, harmful, or inappropriate material;

    (iii) Complying with Elevn’s Terms of Use, Privacy Policy, and applicable laws.

  • Policy Enforcement.

    Failure to comply with this policy may result in account suspension or removal, and may even result in reporting to law enforcement agencies in accordance with the applicable laws. Elevn reserves the right to update this policy in line with changes to child safety standards and applicable laws.

1. GENERAL

1.1. It’s important that you know our policy framework to make an informed choice to use our Services. The Terms of Use and Privacy Policy shall together constitute the entire agreement between you and us regarding our Services. The Terms of Use apply to every agreement we enter into as well as to all our legal actions, regardless of prior instances of exception, failure or delay.

1.2. Unless we agree otherwise in writing, no other terms and conditions may apply to our dealings. Similarly, the Terms of Use will apply in their current version, without modification, unless we agree otherwise. Users must also consult the Terms of Use. This is to ensure we treat all of our Users uniformly, and you are aware of the policies that apply to you.

1.3. Before you enter into an Agreement with us, we will make sure you read the Terms of Use. The Terms of Use are available on our Website. But if you ask us, we can also email them to you.

1.4. None of the provisions of these Terms of Use shall constitute a partnership or joint venture between you and us, and you shall have no authority to bind us in any form or manner.

2. Eligibility and Use of Elevn

2.1. Before you can use our App, you will need to create an Account. To do this, you must acknowledge and warrant the following:

  1. You are at least 18 years old;
  2. You have the legal capacity to enter into a binding contract with Elevn.
  3. Be legally permitted to use the App according to the laws of your own country.
  4. You do not have any unspent criminal convictions, or any court orders related to assault, violence, sexual misconduct, or harassment.
  5. You will not access or use our Website or App if you have previously been removed from Elevn.
  6. You will comply with this Agreement and all applicable local, state, national, and international laws, rules, and regulations.

2.2. By using our Services, you acknowledge and agree to the following terms. We actively monitor for underage usage and may request verification of your Account if we suspect you are underage. We reserve the right to suspend or terminate your Account if we determine that you may be underage.

2.3. The right to use our Services is personal and non-transferable. You are prohibited from using another individual’s Account or sharing your own Account without authorization. To access the App, you will receive a validation code sent to the phone number associated with your Account. You are responsible for safeguarding your phone number and must not allow unauthorized access to it. Elevn is not liable for any misuse that occurs.

2.4. If you believe that the phone number or email associated with your Account has been compromised or accessed by unauthorized parties, you must notify us immediately so that we can block access to your Account.

2.5. The access we provide to our Services is temporary. We reserve the right to determine who is granted access and for how long. You do not have an enforceable right to use our Services beyond the scope we grant.

2.6. You may only use our Services for their intended purpose. The use of the Service is at your own risk and expense, and you are responsible for ensuring that your Account information remains accurate and up to date.

3. In accordance with our policies, we may choose to remove or block access to Users or restrict access to certain features of the App. For example, we may suspend users who have repeatedly cancelled Dates [see Section 8 (Cancelling or Rescheduling a Date) for further details].

3.1. If we have reasonable grounds to question your ability to fulfill your obligations under the Agreement, including but not limited to payment obligations, we reserve the right to suspend performance of our obligations and withhold execution of the Agreement. Should we exercise this right, we will provide you with written notice of our decision.

3.2. While we aim to provide a positive experience, we cannot guarantee the truthfulness of other Users. Additionally, we are not responsible for any incidents that occur during or after a Date. Therefore, it is essential to exercise caution and discretion when interacting with others through our App.

4. LICENSE

4.1. The rights granted to you by Elevn are strictly limited to personal and private use. As a user of Elevn, you grant Elevn a royalty-free, non-exclusive, worldwide, and perpetual license to use, reproduce, display, modify, and translate any intellectual property elements you provide through the App, including but not limited to text, emojis, photos, and videos. This license is solely for the purpose of facilitating communication with other users on Elevn and may extend to displaying such content in various formats across the Website, App, advertisements, restricted-access areas visible to other users, and for other internal purposes.

4.2. Elevn reserves the right to modify, suspend, or discontinue any aspect of the services provided through the App or Website, either temporarily or permanently, with or without prior notice. You acknowledge and agree that Elevn shall not be liable to you or any third party for any changes, interruptions, or termination of services.

5. FUNCTIONING OF THE APP

5.1. You may create an Account on the Elevn App by completing the registration process, which includes providing necessary details to generate a User profile (the "Profile").

5.2. Once a Profile is created, may access and view other Profiles of Users who express mutual interest in each other's Profile (a "Match"), thereby granting them the opportunity to coordinate and schedule a Date through the App.

5.3. Upon a successful Match, Users shall have access to a private chat functionality within the App to facilitate communication.

5.4. The chat functionality is provided solely for the purpose of facilitating interactions between matched Users. Elevn reserves the right to monitor such communications in accordance with applicable laws and its Privacy Policy, for purposes including but not limited to, ensuring compliance with these Terms of Use, preventing misuse, and resolving disputes.

5.5. Matched Users may express their intent to meet in person by utilizing the "Meet Up" option within the App.

5.6. Upon mutual agreement to meet, Users shall be responsible for coordinating a mutually convenient Date through the App.

5.7. Users acknowledge that Elevn does not guarantee the availability of another User for a Date and shall not be held liable for any cancellations, rescheduling, or failure of a User to attend a scheduled Date.

6. COMMUNICATION AND UNSUBSCRIPTION

6.1. By registering on Elevn and providing your Account Information, you acknowledge and agree that you may receive SMS, email, or in-App notifications related to your registration, account activity, and interactions on the platform.

6.2. You may also receive notifications regarding promotional offers, new features, and marketing campaigns available on Elevn. By sharing your Account Information and verifying your contact details, you explicitly consent to receive marketing and promotional communications from Elevn and its authorized representatives through calls, SMS, email, or other electronic means, even if your contact number is listed on the Do Not Disturb (DND) or National Customer Preference Register (NCPR) under applicable telecom regulations.

6.3. Elevn may also send notifications or reminders related to your use of the Services, including but not limited to upcoming dates, profile interactions, and safety alerts. While Elevn endeavours to provide timely notifications, we do not guarantee their delivery and shall not be held liable for any failure or delay in sending such communications.

6.4. You may opt out of receiving marketing or promotional communications at any time by following the unsubscribe instructions provided in such communications or adjusting your notification preferences within the App. However, certain transactional and service-related notifications essential to your use of Elevn may continue to be sent.

7. PERSONAL INFORMATION PRIVACY

7.1. When you register on Elevn or use its Services, we may collect, store, and process certain personal and sensitive information about you. This may include, but is not limited to, your name, phone number, email address, location, occupation, login credentials, and other details you provide during your use of the platform.

7.2. Elevn values your privacy and is committed to protecting your personal information. To ensure transparency, we have established a Privacy Policy that outlines how your data is collected, stored, processed, used, and disclosed. The Privacy Policy forms an integral part of these Terms of Use. If you do not agree with its provisions, please refrain from using Elevn or availing its Services. For further details, please refer to our Privacy Policy.

8. THE OFFER

8.1. Our Services may occasionally be offered with limited validity, such as during special promotions or in cases of significant price fluctuations. These offers may also be subject to specific conditions, which will be clearly outlined in the relevant offer. We reserve the right to revise the prices of our Services at any time; however, any price adjustments will not affect Services that have already been purchased.

8.2. We make every effort to provide accurate descriptions of our Services to ensure you have a clear understanding of your purchase. However, in the event of a clear or obvious error in pricing, we are not obligated to honour the incorrect price.

8.3. Unless otherwise specified by agreed standards or regulations, our Services will be delivered in a manner that aligns with reasonable expectations of quality and performance.

9. CANCELLING OR RESCHEDULING A DATE

9.1. You can reschedule or cancel a Date through the App on their Match’s page.

9.2. Rescheduling a Date means changing the date, time, or location for any reason, and there are no charges for doing so (“Rescheduling”). If you want to Reschedule or Cancel a Date less than 24 hours before the scheduled time, you may do so via the App; however, if the Date does not take place, any amount paid will not be refunded to the user.

9.3. Cancelling a Date means deciding not to meet a Match through the Service (“Cancellation”). While Cancellations may be necessary, repeated or last-minute Cancellations negatively affect other Users. Depending on the number, timing, and manner of Cancellations, Elevn may take the following actions at its sole discretion:

  1. Issue a warning that further Cancellations may result in Account suspension;
  2. Temporarily suspend the User’s Account for up to one week; or
  3. Permanently block the User’s Account from the Service.

9.4. If a Cancellation is due to an exceptional circumstance, you may contact Elevn; however, exceptions to this policy are not guaranteed. You must reschedule or cancel as soon as you become aware that you cannot attend the Date. When Cancelling or Rescheduling, you must notify your Match via the App. Contacting Elevn directly does not constitute a valid Cancellation or Reschedule.

9.5. Elevn reserves the right to change Date Locations at any time. You will be notified in advance or as soon as reasonably possible. If no alternative Date Location is available, you may Reschedule at their discretion.

9.6. Failure to show up at a Date Location without prior notice to a Match may result in suspension or permanent removal from the Service.

9.7. You are prohibited from attempting to bypass the Service by sharing personal contact information when modifying Date arrangements. Violations will result in a warning, and repeated infractions may lead to temporary or permanent Account suspension.

10. USER RESPONSIBILITY

10.1. Elevn facilitates Dates at designated partner venues (“Date Locations”) and may also offer the option of Walk & Talk Dates in public spaces. Regardless of the chosen setting, you are solely responsible for your behavior, interactions, and any events that occur during the Date.

10.2. For Dates conducted at Elevn’s partner venues, the staff at these locations are informed about the nature of the Date and may be approached for assistance should you feel unsafe.

10.3. If you are participating in a Date and feel unsafe or encounter an unwelcome situation, you should immediately contact Elevn through the “SOS” feature in the App or seek help from local authorities.

10.4. You are expected to exercise reasonable caution and sound judgment during all interactions facilitated by Elevn. Elevn assumes no liability for any incidents, disputes, or consequences arising from your participation in a Date. For further details, please refer to Section 15 (Limited Liability).

11. TERM, TERMINATION AND DELETION OF ACCOUNT

11.1. These Terms of Use shall be effective from the date of their publication on Elevn.

11.2. We reserve the right, at our sole discretion, to terminate this Agreement and delete a User’s Account if we determine that:

  1. You have violated any provision of these Terms of Use;
  2. Misrepresentation of information
  3. You have misused the App;
  4. You have engaged in conduct, whether on or off the App, that we consider inappropriate or unlawful, or harmful to Elevn, other Users, or third parties; or
  5. Termination of the Agreement or deletion of your Account is reasonably necessary to protect the interests of Elevn, other Users, or third parties.

11.3. We may also, at our discretion, discontinue any active subscription(s) without refund. All such terminations shall be final and made at Elevn’s sole discretion, and Elevn shall not be liable to you or any third party for any termination of your Account.

11.4. In the event of termination or account deletion, we will provide you with a notice stating the reasons for our decision.

11.5. You may also delete your Account at any time for non-subscribed users but on the last subscription day for subscribed users by logging into the App and following the instructions for account deletion. In addition to deleting your account, you must separately cancel or manage any recurring subscriptions purchased through a Third-Party Store (e.g., iTunes, Google Play) to prevent further charges. Deleting your account does not automatically cancel such subscriptions, and failure to do so may result in continued billing, for which we are not responsible.

11.6. We shall not be liable for any direct, indirect, or consequential damages arising from or related to the termination of this Agreement or deletion of a User’s Account.

11.7. If your account is terminated, whether by you or by Elevn for any reason, all provisions of these Terms of Use that are intended to survive termination shall remain in effect. This includes, but is not limited to, provisions relating to dispute resolution, ownership rights, warranty disclaimers, and limitations of liability. Your information will be retained and deleted in accordance with our Privacy Policy.

12. PRICES

12.1. Unless otherwise agreed, all amounts quoted by us include GST.

12.2. If we have provided a bundled or composite price for our Services, and you choose to utilize only a portion of the offered Services, you will still be required to pay the full stated amount. For instance, if a Date package includes a complimentary drink, but you opt for a different location instead of the designated Date Location, you will not be entitled to claim the included drink. In such cases, we are not obligated to provide any partial refunds or price adjustments.

12.3. Any discounts or quoted prices are applicable only to the specific transaction for which they were offered and do not automatically extend to future Agreements.

13. PURCHASES, SUBSCRIPTIONS AND PAYMENTS

13.1. If you want to purchase a Service, we may require certain information from you in order to perform/deliver that Service. Failure to provide this information or providing it late may result in us being unable to perform the Service and/or may have consequences for the execution of the Service. We are not liable for damages related to or arising from the failure or untimely provision of the required information.

  • 13.1.1. Purchases and Payment Terms

Elevn may offer products and services for purchase within the App (“In-App Purchases”). By making an In-App Purchase, you acknowledge and agree that additional terms and conditions, as disclosed at the point of purchase, may apply. Such additional terms are incorporated into these General Terms by reference.

You may complete an In-App Purchase through the following payment methods (“Payment Methods”): (a) third-party platform, such as the Apple App Store or Google Play Store (“Third-Party Store”); or (b) Direct payment via credit card, debit card, or PayPal, which will be processed through a third-party payment processor. By making an In-App Purchase, you authorize Elevn to charge your selected Payment Method for the applicable amount. If payment is not successfully received, you agree to promptly settle all outstanding amounts upon our request.

  • 13.1.2. Subscriptions and Auto-Renewal

Certain premium services may be available as recurring subscriptions (e.g., weekly, monthly, or quarterly). If you subscribe to such services. If you purchase an auto-renewing subscription, your subscription will automatically renew at the end of each period unless you cancel before the renewal date.

  1. You will be charged at Elevn’s then-current rate for the applicable subscription unless you cancel prior to renewal.
  2. Deleting your account or removing the App does not cancel your subscription; you must manually cancel it via your account settings or through the Third-Party Store from which the subscription was purchased.
  3. If there are changes to the subscription price, you will receive prior notice and have the option to cancel before the next billing cycle.
  • 13.1.3. Cancelling of Subscriptions

If you purchased a subscription directly from Elevn, you may cancel or modify your Payment Method through the payment settings section within your profile on the App. If your subscription was purchased via a Third-Party Store (such as the Apple App Store or Google Play Store), you must manage or cancel it directly through that platform by following its designated cancellation procedures. Upon cancellation, you will continue to have access to the subscription benefits until the end of the current billing cycle, after which the subscription will not renew, and access to any associated Premium Services or In-App Purchases will be discontinued. Unless expressly stated in the Refunds subsection below, cancellations do not entitle you to a prorated refund for any unused portion of the subscription.

Cancelling your subscription does not automatically remove your profile from Elevn, as our Services can be accessed without a subscription. If you wish to permanently delete your account, you must follow the account termination process outlined in Section 11 (Term, Termination and Deletion of Account) of these Terms of Use.

Elevn reserves the right, at its sole discretion and without prior notice, to modify or discontinue any product, feature, service, or promotion; impose conditions on the application of discounts, coupons, or promotional offers; restrict or prohibit certain transactions; and decline to provide any product or service to a User or honor any offer.

13.1.4. Free Trials

By signing up for a free trial, you acknowledge that, unless you cancel before the end of the trial period, your trial will convert into a paid subscription, and your Payment Method will be charged at the then-current subscription rate. Once the free trial converts to a paid subscription, it will automatically renew at the end of each subscription period, and your Payment Method will be charged accordingly, unless you cancel prior to the renewal date. To prevent charges for the next subscription period, cancellation must be made before the end of the current trial or subscription period, as applicable. Please note, deleting your account or removing the application from your device does not constitute cancellation of your free trial or subscription. If you have previously signed up for a free trial through the Apple App Store or Google Play Store, you are not eligible for another free trial, and you will be automatically enrolled in a paid subscription with charges applied as outlined above.

  • 13.1.5. Refunds

Payments made are generally non-refundable under any circumstances, and once a payment is processed, no refund will be issued, even if your membership is terminated. However, exceptions may apply if a refund request is made within 2 days of the transaction date, the payment was made in a currency other than INR, the paid goods remain unused, and if the laws applicable in your jurisdiction provide for refunds. If these conditions are met, the refund will be processed within 7 business days.

For any payment-related queries concerning transactions made via iOS devices using your Apple ID, please direct your inquiries to Apple, not to Elevn. To request a refund, visit https://getsupport.apple.com. If the payment was made through the Google Play Store, please contact Elevn customer support by providing your order details and invoice from the Google Play Store. For payments made via the Website or any other payment gateway, please reach out to Elevn customer support with your order details and invoice.

14. USER CONTENT AND MONITORING

14.1. Elevn is committed to fostering a respectful, safe, and engaging environment for all users. Given the personal and social nature of interactions on our platform, users are expected to comply with Elevn’s Community Guidelines, which outline appropriate conduct and content standards. These guidelines govern user-generated content, including but not limited to profiles, photos, messages, and other communications. You may review the full guidelines here: www.elevncommunity.com.

14.2. To maintain the integrity of the platform, Elevn monitors user content for compliance with its guidelines. This moderation process includes both automated systems and manual review mechanisms to promptly identify and address any content that violates our policies. While automated tools assist in detecting potential violations, Elevn ensures that flagged content undergoes manual assessment to account for contextual nuances and minimize errors.

14.3. By using Elevn, you acknowledge that any content you share on the platform must align with our standards, and we reserve the right to remove, restrict, or take appropriate action against content that breaches our policies.

15. LIMITED LIABILITY

15.1. You are solely responsible for your interactions with other Elevn users. While Elevn reserves the right to monitor and intervene in disputes at its discretion, we are under no obligation to mediate, arbitrate, or facilitate the resolution of any disagreements between users. Elevn does not provide dispute resolution or settlement services but retains the right to take any action deemed appropriate against users who violate our policies.

15.2. To the fullest extent permitted by law, Elevn, its affiliates, employees, agents, licensors, and partners shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages arising from or related to your use of the Elevn app, Website, or Services. This includes, but is not limited to, bodily injury, emotional distress, financial loss, loss of data, income, or profits, damage to property, unauthorized access to or alteration of user data, disruptions or errors in the operation of the app, and any issues resulting from interactions, communications, or meetings with other users.

15.3. The above limitations shall apply even if we were notified of the potential for such damages. If you are dissatisfied with our Services in any way, your sole and exclusive remedy is to discontinue your use of the Services.

15.4. We specifically disclaim any liability for incidents that may occur during Dates. Additionally, we are not responsible for any events that take place when you purchase a Service that includes a ride-availing feature. We trust you to act responsibly and take appropriate precautions to ensure your safety and well-being. While we make efforts to curate safe and enjoyable experiences, we cannot guarantee the behaviour of other users or control the events that may occur during a Date. If you feel unsafe or require assistance during a Date at a venue, we encourage you to contact the venue staff.

15.5. If you invite another person to join Elevn via text, email, or any other messaging service, you acknowledge that you are solely responsible for any charges or fees incurred in connection with such communications. Elevn is not liable for any costs related to user-generated invitations.

15.6. You acknowledge that Elevn is not responsible for any guidance, instructions, or advice provided through the App or Website. We expressly disclaim liability for any claims, damages, disputes, or legal actions arising from your reliance on any content, communications, or services offered on the platform.

15.7. You hereby waive any and all claims arising out of your use of our Services. To the maximum extent permitted by law, Elevn’s total liability arising from or related to your use of the platform, regardless of the legal basis (contract, tort, warranty, or otherwise), shall not exceed the total amount of fees you have paid to Elevn for any purchases made through the App or Website.

15.8. The limitation of liability set forth herein is a fundamental aspect of the bargain and represents a fair allocation of risk. Our Services would not be offered without these limitations, and you agree that the limitations and exclusions of liability, disclaimers, and exclusive remedies outlined here will remain in effect, even if they are found to have failed in their essential purpose. However, this limitation does not apply to liability arising from Elevn’s own acts of omission or commission, negligence, or the deliberate withholding of information that directly caused harm, nor to any liability that cannot be restricted under applicable law.

16. INDEMNITY

16.1. You are fully responsible for your actions and any content you share on Elevn. By using the App, you agree to indemnify, defend, and hold harmless Elevn, along with its affiliates, partners, licensors, contractors, officers, directors, employees, representatives, and agents, from any third-party claims, damages (both actual and consequential), liabilities, losses, costs, expenses (including reasonable legal fees), or legal proceedings that may arise due to: (i) your negligence, misconduct, or omissions; (ii) your use of the App; (iii) any content you upload or submit; (iv) your violation of these Terms; and/or (v) any breach of applicable laws or third-party rights.

16.2. Elevn reserves the exclusive right to settle, resolve, or make payments for any claims or legal disputes against it without requiring your prior approval. If needed, you agree to provide full and reasonable cooperation in defending such claims.

16.3. However, this provision does not require you to indemnify Elevn for any fraudulent, deceptive, or unconscionable business practices, misrepresentation, or the omission, concealment, or suppression of any material fact related to the App.

17. SAFETY

17.1. Elevn does not conduct criminal or formal background checks on its users, nor does it verify the accuracy of statements made by users. You acknowledge and accept that interacting with other users, whether online or offline, carries inherent risks, including but not limited to meeting new individuals, dating, and personal interactions. You are solely responsible for taking all necessary safety precautions when using the App and engaging with other users.

17.2. Elevn does not guarantee the accuracy, completeness, or reliability of any information provided by users. While reasonable efforts are made to maintain accurate and up-to-date information on the App, Elevn does not warrant that the information available is error-free, and reliance on such information is at your own risk.

17.3. Users are strictly prohibited from posting, transmitting, or sharing any content that is defamatory, false, abusive, obscene, profane, offensive, sexually explicit, threatening, harassing, racially offensive, illegal, or that infringes upon the rights of any third party. Elevn reserves the right to remove any such content and take appropriate action, including suspension or termination of the User’s account.

17.4. Elevn does not knowingly collect data from minors. If a user misrepresents their age and fraudulently claims to be 18 years or older, Elevn is not responsible for any consequences arising from such misrepresentation. In the event that a minor’s account is identified, a parent or legal guardian may contact Elevn to request the deletion of the minor’s data. Elevn will take prompt action to remove the minor’s information from its platform upon verification.

18. DISCLAIMERS

18.1. Elevn does not guarantee that any matches, profiles, or interactions facilitated through the App will be compatible, successful, or lead to a meaningful relationship. The services provided by Elevn are intended solely for the purpose of social and personal connections, and any outcomes derived from them are at the user's own discretion and risk.

18.2. Elevn strives to provide uninterrupted, secure, and error-free access to the App. However, access may be temporarily suspended or restricted due to maintenance, system updates, technical issues, or other unforeseen circumstances. Elevn does not take responsibility for any disruptions arising from internet connectivity issues, technical failures, or factors beyond its reasonable control.

18.3. Elevn does not warrant that:

  1. The services will be uninterrupted, timely, secure, or error-free;
  2. Any defects, bugs, or errors in the App will be corrected;
  3. The content or information available through the App, including user-generated content, will be accurate, complete, or up-to-date; or
  4. Any feedback, recommendations, or suggestions provided by Elevn will be incorporated into the App.

18.4. Elevn does not pre-screen, endorse, or take responsibility for any content, messages, photos, videos, or other material posted, sent, or received by users or third parties through the App. Users are solely responsible for their own content and interactions on and off the platform. Any material downloaded or accessed through the App is done at the user’s own discretion and risk.

18.5. Elevn disclaims all liability for any conduct of users, both on and off the App, including but not limited to any offensive, inappropriate, obscene, unlawful, or harmful behavior. Elevn does not assume responsibility for any loss, damage, injury, or harm resulting from interactions between users, whether online or offline.

18.7. The services provided by Elevn are offered on an "as is" and "as available" basis without any express or implied warranties, except as expressly specified in writing. To the maximum extent permitted by applicable law, Elevn disclaims any liability for:

  1. The accuracy, reliability, suitability, or completeness of any content on the App, including user-generated content;
  2. Any interruptions, delays, security breaches, or unauthorized access affecting the App;
  3. Any damages, injuries, claims, or losses arising from the failure, omission, error, defect, or unauthorized access to user records, data, or communications; and
  4. Any third-party services, advertisements, links, or external platforms accessed through the App.

18.8. Elevn does not assume any responsibility for third-party websites, advertisements, or services that may be linked to or accessible from the App. Any such access is at the user’s own risk, and Elevn does not endorse or make representations regarding the content, accuracy, or security of third-party platforms.

18.9. To the extent permitted by law, Elevn disclaims any liability for any loss, damage, expense, or claim arising out of or in connection with the use of the App, including but not limited to system failures, errors, technical disruptions, data loss, security breaches, or any interactions between users.

19. FORCE MAJEURE

19.1. Elevn will not be held responsible for any delay or failure to comply with its obligations if the delay or failure arises from any cause which is beyond Elevn’s reasonable control.

19.2. In the event of a force majeure situation that prevents us from fulfilling our obligations, we may suspend such obligations until it becomes feasible to resume them. If the force majeure situation persists for 14 calendar days, either party may terminate the Agreement, in whole or in part, by providing written notice. In the case of force majeure, you agree that no compensation will be due for any damages you may have incurred, even if we have gained some benefit from the force majeure situation.

20. WARRANTY AND RESTICTIONS

20.1. We guarantee that our Services comply with the Agreement, our commitments, the specifications stated in our offer, the reasonable requirements of soundness and usability, and the legal provisions and regulations that exist at the time the Agreement is concluded.

20.2. By using Elevn, you represent and warrant that:

  1. Your use of the platform and its services complies with all applicable laws and regulations.
  2. Any information you provide to Elevn is true, accurate, and lawful.
  3. The content or material you share does not violate Elevn’s policies or guidelines, nor does it cause harm, including defamation, to any person or entity.

20.3. If any information provided by you is found to be false or misleading, Elevn reserves the right to suspend or terminate your account, restrict your access to the platform, and take appropriate action without prior notice. You agree to indemnify Elevn and its affiliates against any claims arising from your breach of these warranties.

20.4. You agree to use Elevn solely for lawful purposes and in accordance with its intended functionality. Any activity that disrupts, harms, or otherwise misuses Elevn’s platform or services is strictly prohibited.

20.5. You may not use Elevn, its services, or its content for any commercial, resale, or unauthorized purpose.

20.6. You shall not:

  1. Modify, delete, or manipulate any content on Elevn, including information about services, pricing, or features.
  2. Use automated tools (such as bots, scrapers, or crawlers) to access, navigate, or collect data from Elevn.
  3. Make false, misleading, or defamatory statements about Elevn, its services, or its users.
  4. Upload, transmit, or distribute any harmful software, viruses, or other malicious content that may interfere with Elevn’s functionality or security.
  5. Engage in hacking, data mining, or any activity designed to breach Elevn’s security or technological infrastructure.
  6. Attempt to gain unauthorized access to any part of Elevn’s platform, servers, databases, or related systems.
  7. Engage in disruptive or harmful online behavior, including but not limited to “spamming,” “phishing,” “trolling,” or “griefing.”

20.7. You are strictly prohibited from posting, transmitting, or sharing any content on Elevn that:

  1. Belongs to another person without the necessary rights or authorization.
  2. Is defamatory, obscene, harassing, hateful, or otherwise inappropriate.
  3. Exploits or harms minors in any manner.
  4. Infringes upon intellectual property rights, including patents, trademarks, or copyrights.
  5. Violates any applicable laws or regulations.
  6. Is misleading, deceptive, or intended to cause harm.
  7. Impersonates another person or misrepresents your identity.
  8. Contains malware, viruses, or any software designed to disrupt, damage, or compromise Elevn’s platform or user experience.

20.8. Failure to adhere to these restrictions may result in the suspension or termination of your account and potential legal action.

21. GRIEVANCE REDRESSAL

21.1. You may submit any grievance with respect to Elevn or the Services, including with respect to any abuse on Elevn including any discrepancies or grievances with respect to access or usage of Elevn in violation of these Terms of Use by any person, to the Grievance Officer at:

21.2. We will acknowledge this complaint within 48 hours and resolve it within 14 days of receipt.

21.3. If you notice a User displaying any content on their Account depicting you in the nude, either partially or fully, engaged in any sexual act, or electronically impersonating you (including by artificially modifying your images), please complain to us/report the profile immediately. We will remove or disable access to such content within 48 hours.

22. ASSIGNMENT

You may not assign or transfer your rights and obligations under this Agreement to any third party without obtaining prior written consent from Elevn. Any attempt to assign your rights and obligations without Elevn’s prior written approval shall be deemed null and void.

23. CONTENT ON THE PLATFORM

23.1. All text, images, graphics, logos, icons, software code, interface elements, design structures, and the arrangement of content on Elevn (collectively, “Elevn Content”) are the exclusive property of Elevn and are protected by applicable intellectual property laws, including copyright and trademark laws. Additionally, all trademarks, service marks, trade names, and trade secrets associated with Elevn, whether displayed on the platform or not, are proprietary to Elevn.

23.2. Elevn may display third-party logos, trade names, and trademarks belonging to other brands in accordance with licensing agreements or permissions granted by such brands.

23.3. No Elevn Content may be copied, reproduced, republished, distributed, sold, resold, uploaded, transmitted, or otherwise exploited for any purpose, including commercial use, without prior written consent from Elevn. You are prohibited from framing or using framing techniques to enclose any Elevn trademark, logo, or proprietary information (including text, images, page layouts, or forms) without explicit written authorization. Similarly, you may not use meta tags or any other hidden text incorporating Elevn’s name, trademarks, or branding without prior written consent. Any unauthorized use of Elevn Content will result in the immediate termination of the permissions granted under these Terms of Use and may lead to legal action.

24. INTELLECTUAL PROPERTY

24.1. All intellectual property rights related to or arising from the performance of this Agreement are owned exclusively by Elevn. You are granted only a non-exclusive, non-transferable right to use such intellectual property, as specified in these Terms of Use and as permitted by law. Any additional rights are expressly excluded.

24.2. Unless otherwise explicitly agreed in writing, the rights to the data mentioned in this section remain the property of Elevn, irrespective of whether costs were charged to you for their creation. You are not authorized to grant sublicenses to third parties without obtaining Elevn's prior written consent.

24.3. In the event that we provide you with documents, you may only use them for your own purposes, except when it is necessary to share such documents with third parties for the execution of this Agreement. This sharing may only occur with Elevn's prior approval, and a confidentiality agreement may be required if deemed necessary.

24.4. We retain the right to use the knowledge gained during the performance of this Agreement for other purposes, but we will not disclose any of your confidential information to third parties.

24.5. Elevn reserves the right to use non-attributable information, such as written information from your Account, for its own purposes.

24.6. With your consent, we may use your name and photograph as a reference or for promotional purposes.

24.7. You also agree to indemnify Elevn against any claims of intellectual property rights infringement by third parties arising from your actions.

24.8. In the event of a violation of this section, Elevn reserves the right to pursue any legal remedies available.

25. MANAGEMENT OF THE APP

25.1. Elevn reserves the right to modify the technical infrastructure of its Services, including the App, at any time. When accessing and using these technical features, you must act as a responsible and diligent user of the Services.

25.2. You are solely responsible for any use, including unauthorized use, that arises from your access or usage rights. You must take reasonable and appropriate measures to prevent unauthorized access. Your user and access rights are strictly personal and may not be shared with third parties. You agree to comply with all instructions provided by Elevn regarding the use of its Services.

25.3. Elevn may also modify non-technical aspects of its Services or the App. In cases where modifications require significant adjustments on your part, we will endeavor to notify you at the earliest opportunity.

25.4. If any technical component of our Services causes a system malfunction or delay, we may suspend or remove the affected component, block access, or take other necessary actions without prior notice. You acknowledge and agree that in such cases, you waive any claims for compensation or indemnification.

25.5. Additionally, Elevn may temporarily suspend or restrict access to its Services for maintenance, upgrades, or improvements. We are not obligated to provide prior notice of such actions, and you shall not be entitled to any compensation or indemnification for any resulting inconvenience or disruption.

26. CONFIDENTIALITY

You are required to maintain the confidentiality of any confidential information disclosed to you by Elevn. Confidential information includes any information expressly designated as confidential, as well as any information that, by its nature, should reasonably be understood to be confidential.

27. GOVERNING LAW AND DISPUTE RESOLUTION

These Terms of Use, any transactions conducted between you and Elevn, and your relationship with Elevn shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles. Any disputes arising in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Mumbai, Maharashtra.

28. SURVIVAL

The provisions of these Terms of Use and conditions and the Agreement that are intended to remain in effect after termination of the Agreement will continue to apply.

29. WAIVER

No provision of these Terms of Use shall be considered waived, nor shall any breach be deemed excused, unless such waiver or consent is expressly provided in writing and signed by Elevn. Any waiver or consent granted by Elevn, whether express or implied, in response to a specific breach by a user shall not be construed as a waiver, consent, or excuse for any other, different, or subsequent breach.

30. SEVERABILITY

If any provision of these Terms of Use is held by a court of competent jurisdiction to be unenforceable under applicable law, then such provision will be excluded from these Terms of Use and the remainder of these Terms of Use will be interpreted as if such provision were so excluded and will be enforceable in accordance with its terms; provided however that, in such event, these Terms of Use will be interpreted so as to give effect, to the greatest extent consistent with and permitted by applicable law, to the meaning and intention of the excluded provision as determined by such court of competent jurisdiction.

31. AMENDMENTS AND MODIFICATIONS

31.1. Elevn reserves the right to unilaterally amend or supplement these Terms of Use at any time. Any such changes will take effect immediately upon posting on our Website, App, or notifying you via email or other means, unless stated otherwise. You are encouraged to review these Terms periodically to stay informed of any updates.

31.2. If any modification materially alters our obligations or your rights under the Agreement, we will provide reasonable notice, and you will have the right to reject the revised terms. If you do not agree with the modifications, you must immediately stop using our Services. Your continued use of Elevn after any changes have been made constitutes your acceptance of the revised Terms.

32. MISCELLANEOUS

32.1. Elevn, including its services, platform, and app, may be acquired, in whole or in part, by another entity. This acquisition may occur without prior written notice to you.

32.2. If you breach these Terms of Use and we do not take immediate action, it does not waive our right to pursue any remedies or rights in the event of any future breaches of these Terms of Use.

32.3. If you encounter any suspicious activity while using Elevn, you must immediately report it to us at grievances@elevncommunity.com.

32.4. In addition to these Terms of Use, you agree to comply with the terms and conditions of any third-party services, including but not limited to payment processing services or promotional offers, which may be provided through or linked within Elevn’s platform. Elevn is not responsible or liable for any transactions or issues that arise between you and these third parties.

32.5. These Terms of Use supersede any prior oral or written terms and agreements between you and Elevn regarding the use of our platform and services. Your rights and responsibilities in relation to Elevn are strictly governed by these Terms of Use.
